Wedding Paperwork in Australia: The Three Documents You Need to Know About!

Ahhh, wedding paperwork.

Not exactly the most exciting part of planning your big day, is it?

But unless you’re planning on having a very expensive party where you simply pretend to get married, there’s a little bit of paperwork we need to take care of!

The good news?

It’s actually pretty straightforward.

And if you’re working with me, I’ll guide you through the entire process to make sure everything is completed correctly and, most importantly, on time.

Because when it comes to getting legally married in Australia, there are three key documents we need to take care of.

And yes, they’re all time-sensitive!

1. Notice of Intended Marriage (NOIM)

This is where the legal paperwork journey begins.

The Notice of Intended Marriage, commonly referred to as the NOIM, is the document that formally notifies your celebrant of your intention to marry.

It must be lodged with your celebrant no earlier than 18 months and generally at least one month before your wedding date.

So, if you’re planning a wedding, this is one piece of paperwork you definitely don’t want to leave until the last minute!

Now, there’s a little more involved than simply filling out a form.

We’ll also need to verify your identity and confirm a few important details, which means providing the appropriate identification and supporting documents.

Depending on your circumstances, that might include a passport, birth certificate, divorce order or other relevant documentation.

And in certain situations, a statutory declaration may also be required.

Every couple’s circumstances are different, so rather than overwhelm you with every possible scenario here, I’ll guide you through exactly what’s needed for yours.

There are also a few steps involved in having your signatures appropriately witnessed.

But don’t stress.

I’ll guide you through the process and make sure everything is completed correctly.

And here’s a little bonus.

We don’t necessarily need to meet in person to get it done!

Provided we’re all physically in Australia at the time, I can witness your NOIM signatures over a quick video call.

That might mean jumping on Zoom for five minutes to get the paperwork sorted.

Or, if you prefer, we can use the opportunity to have a proper catch-up and chat about the next exciting stage of your wedding planning.

There are also other authorised people who can witness your NOIM, so if we’re unable to coordinate a time, you’ve got options.

Either way, we’ll make sure it’s taken care of.

2. Declaration of No Legal Impediment to Marriage

Sounds pretty official, doesn’t it?

That’s because it is!

This document is essentially a declaration from both of you confirming that there’s no legal reason preventing you from getting married.

Things like already being married to someone else, for example.

Pretty important detail, that one!

Unlike the NOIM, this document is completed much closer to your wedding day.

It must be signed before your marriage ceremony, and I’ll personally guide you through that process.

There’s also another important part of the process.

As your celebrant, I’m legally required to meet with each of you separately and in person before your wedding ceremony.

And there’s a very good reason for that.

It’s an opportunity for us to have a private conversation, ask a few important questions and make sure you’re both entering into your marriage freely and genuinely consenting to it.

It’s not an interrogation, I promise!

Just another important step in making sure everything is as it should be before the big day.

It’s another simple step, but an important one.

And once it’s done, we’re one step closer to the big day!

3. Official Certificate of Marriage

And finally, the last piece of the paperwork puzzle.

The Official Certificate of Marriage (the one submitted for registration).

This is one of the official documents we’ll sign as part of your wedding ceremony, along with your two witnesses.

Now, here’s something worth knowing.

This isn’t the same as the beautiful certificate you’ll receive from me on your wedding day.

That one’s known as the Form 15 Certificate of Marriage.

Or, as I like to call it…

The pretty one!

It’s a lovely keepsake, and it’s yours to take home. I even present it in a frame, with your vows tucked in behind it, creating a beautiful keepsake to remind you of your day for years to come.

But the official certificate we complete is part of the paperwork that gets submitted to Births, Deaths and Marriages.

And once your marriage has been registered, you can obtain your official registry-issued marriage certificate if you need it for things like changing your name or updating legal documents.

So, What Happens to All That Paperwork?

Well, that’s where I come back into the picture.

Once your ceremony is complete and all the necessary documents have been signed, I’ll take care of submitting everything to the appropriate Births, Deaths and Marriages registry.

Which registry?

That depends on which Australian state or territory you get married in.

And there’s another important deadline here.

Your celebrant must submit the required paperwork within 14 days of your wedding.

From there, the registry processes the documentation and registers your marriage.

See? Not So Scary After All!

Look, I completely understand that legal paperwork isn’t the part of wedding planning that gets everyone excited.

The last thing you need is to be worrying about whether you’ve completed the right form at the right time.

And that’s exactly why I guide my couples through the process.

I’ll help make sure the paperwork is taken care of, so you can concentrate on the fun stuff.

Happy planning.

Ryan.
